Open Question: Will buying house in NYC affect my mother (62) eligibility for any type of medicare or other import. program?
We want to buy a co-op or a house for her in Queens, NY. I will be paying most of the mortgage. Currently both of us are renting. The reason why I want her to buy it, is because, I'd like, if I can afford it, to buy another house for my family in several years. But I realize that with two mortgages, my interest rate would be very high (for the second mortgage). Also she could qualify for SUNYMAY program, which I can't. But I don't want to do this if it will affect her eligibility for any important medical program like Medicare (I realize there several levels of Medicare) or assisted-living programs. I already checked that it will not affect her SS eligibility, but I see contradictory information on Medicare - I think it's state-specific. It seems to be a very important decision, and can't find the info. Please help.

For the past several years, I have encountered difficulty getting the free annual credit report from the credit bureaus. For "security purposes", they each ask some questions ( 2 or 3) to verify my identity -- one always involves a mortgage -- and I always give the correct response (I don't have a mortgage). This renders the other question/s about the mortgage inaccurate as well.
Regardless, I have continually gotten the message (after declining to purchase additional services), that I need to mail in additional information to confirm my identity, or wait for some code to show up in the mail that I can use to view my report. I believe there is a phone option as well.
Initially the trouble was only with TransUnion, which lasted for a few years. I have not been able to access my free credit reports beyond the second year after the program's introduction.
I was wondering if anyone else has experienced difficulty gaining access to their free credit reports?

I have called social services trying to get them involved in a matter where my ex is verbally abusive and puts our son's physical well-being in harms way. He screams at him, yells, belittles, threatens, bashes me in front of him and the list goes on. He moved way out to the country where there are no neighbors and therefore nobody can hear all the fighting. Social services has said there is nothing they can do without evidence and because there is no reports of bruises and broken bones there is little they can do. They said it is very hard to get involved in family when there is no physical abuse (or no proof of it)This person is a loose cannon. He is a very angry person and I want to get my son out of his house. Our son is almost 16 so some lawyers say that he may be able to tell a judge where he wants to live but I want some solid proof that this guy is nuts, because nobody believes me or my son. This guy could charm the pants off a priest, he is like jekyl and hyde.... There are other kids in the house, they are not mine but they are in just as much danger, although my son seems to get the worst of the abuse. Can private detectives trail him and record some of his crazy antics? He drives like a lunatic with the kids in the car, he chases people down with crowbars in front of the kids, he has gotten handcuffed in front of the kids for fighting, he drives drunk with kids in the car, he has our 15 year old son drive the whole family home when he and the wife were too drunk (15 year old with no permit or license) I mean the list goes on. I cannot believe this guy can just keep slipping through the cracks. If I hired a private detective what kind of info can they get for me to take to a custody hearing, where the judge will see he is a lunatic. In my past I had problems but that was 10 years ago and am a completely different person..100% changed. I thought it would cost less to have a P.I. get information about the crazy ex, and dangle that in front of his nose, showing him he does not have much of a leg to stand on should I take him to court rather than spend $10,000+ on a custody battle. That kind of money would require a second mortgage and then no braces or college help for the kids. What kinds of things can a P.I. do? Can they interview people who know him, who believe he is a danger? i really need some help. so for anybody who can give me some advice i really appreciate it and so does my son.

This is my second post to this question, because after reading your responses I realized there is quite a bit of information that you need to give me a more precise response. So here it is...
In 2005 my then fiancee was in a no fault near-fatal car accident. He raked in over $200,000 in medical bills and was unemployed at the time, since he had just graduated from college. For some reason his parents had let his health insurance lapse under the assumption that he would find a job before he needed any medical treatments.
Since I had also just graduated, i was also unemployed so I decided rather then to find a job to help nurse him through his rcvoery. I returned to work in Sept and he in Jan of 2006. We began paying off what we could on our small incomes but his parents were not helping us at all, and my parents were doing as much as they could afford to, but we slowly began to fall further and further behind on our bills.
In August of 06 I began law school thinking that it wouldn't hurt us too bad financially since I had a few small scholarships and loans. But I was soo wrong. We again began to slip on our bills and even after we both picked up part time jobs, it was to late. I decided not return to law school until we were paid up on all our bills (and hope to finally return to school next fall). We were able to get his med. bills down to $23k, which is a big drop from the original $234k bill, but still a very large number.
We have been curent on our bills for over 12months and have been advised by all the mortgage brokers we have spoken to not to pay any more of his medical bills due to the amount of time that has past. There is no more money (that we know of) coming from his accident and we used what we did get from insurance to buy him a new car and pay some of the bills. We make decent money now, pay for everything with cash, but occasionally use our credit cards to show the creditors that are able to use them pay them off on time. We make fairly decent money for our age and that is how we are albe to put so much into our investments and savings. Oh and we have 2 cars paid in full. I hope this helps.

Help! I just received a letter from my current mortgage company that we owe $6k!!! It says that we weren't paying enough on our escrow to cover the taxes. So in order to make up for it, they doubled our monthly payment. I cannot afford this new payment! It turns out that the original mortgage company I went through submitted the wrong payment amounts for my escrow. So instead of paying $400 a month for escrow we were only paying $100. It is a new constructed home, but the title company fixed the first page of my HUD with the new tax amounts for the pro-rated amount. However, the second page of the HUD wasn't updated, hence now I am stuck in the predicament of perhaps losing my home. Is it the mortgage company's fault for submitting the wrong numbers or is it the title company's fault for not fixing both portions of the updated taxes, or is it both of their faults? Please help! I have no clue what to do or who to go to or how to handle this situation. Any information will help! I just don't think it's fair that I could possibly lose my home (since I can't make the doubled payments) because of a company's clerical error. I have had great financial difficulty this past year, and have fallen behind on many of my obligations, due to drastic income loss. I was behind on my 2nd mortgage, and was trying to work out a loan modification with them, when I called today to find out the status, they informed me that my loan is now closed and charged off. I think I understand what that means, that is a banking term and I am still liable for that debt. My question is; is this debt still a lien on my home, and if is not, can I file it in my chapter 7 bankruptcy? The bank told me that they would not forclose on the home. I have tried to research this, but not finding any luck with the questions I have. I spoke with my attorney, and she said that I would have to file a Chapter 13, or else the 2nd mortgage would forclose...Does any one have any information, or gone through a simular situation?

Bought my house way overpriced in 2005. started renting it in second half of 2007 and moved back in with my parents. The rent is about half the mortgage, and I pay it all to my parents (they basically cash my checks), since they are not doing that well financially.

Hi my name is Jane and I am living in Virginia.
I purchased a house in Woodbridge VA in Dec/2004.Tom was my mortgage agent. I made 10% deposit. (Contract amount was $535,000.00)
US Express Mortgage Company approved first and second mortgage (1st $374K and 2nd $107K). About two months after settlement I received check book from BB&T Bank (3rd lien - Line of Credit $125,000).
I called Tom (Mortgage Broker) and asked about the check from BB&T because I had never applied or asked Raymond to open a Line of Credit for this property. He said "Jane, you did not need a loan application and you didn't have to sign anything because you have a good credit and your Woodbridge house had an immediate equity right after you closed the deal. So BB&T approved the loan based on your excellent credit and equity of your house.
By the way I did not close the account and unfortunately I used the money.
December, 2008, the house was foreclosed (by 1st lien holder) and 3rd mortgage lender; BB&T Bank filed a lawsuit against me in the amount of $125K. I received complaint by mail in 01/15/2009.
* Right before foreclosure I requested all the documents regarding this loan to the entire lender including BB&T. (I was not sure what they have but I tried.)
Shockingly enough, there was a Loan Application which I have never seen and someone forged my signature.
BB&T Bank was not a wholesale lender. (BB&T had a wholesale department but I am not talking about them)/I didn't know at that time because Tom and Bank loan officer were acting like they are…/The loan officer had to contact with borrower directly but it didn't happen. Someone forged my signature in Loan Application, Credit Line Agreement, and Credit Line Deed of Trust (Notary Public? I don't know who she is and there was no seal)
So they foreclosed my house and also asked me to pay. Yes I did use the money. If I have to pay then I have to. But how about a FRAUD. (Forgery and violation of lender’s liability...
Q #1. What should I do? Do I have to pay them and bury that fraud?
#2. We have 2 years of statute of limitation for fraud in Virginia. Someone told me that when I received the checkbook from BB&T Bank I should have known that it was a FRAUD (He said this is common sense). What do you think? I confirmed fraud when I saw someone forged my signature on Dec.2008–My deference is –“Jane you did not need….. your excellent credit and equity of your house.”

My mom is someone you just have to know in person to understand how she is... basically, VERY controlling, overbearing, HAS to be right, her way or NO way type of person. She and I are always off and on with fights, not speaking for weeks or months. This time, I feel she has crossed the line and I wish to not speak to her anymore.
My fiance and I have been engaged for 7 months, going to wed in September. We want a pretty nice wedding, sort of elegant...but my mom has her own vision and fights as to where the wedding should be caused us not to speak (we wanted a banquet hall, she wanted us to do it in someone's small backyard or a barn at an orchard). She was so mad that we turned down her suggestions that she said we were being selfish and could do it ALL on our own without her help. So we are spending a LOT of our own money to do this wedding. Everything is pretty much done, scheduled, picked out, purchased. Yet to this day she is still trying to convince me to cancel everything & do it in my aunt's backyard. And she absolutely HATES my color choices (pool blue & chocolate brown). She says the blue is too Spring/Summerish and she is REFUSING to buy her daughter's (my sister's) bridesmaids dress in that color..says if I want Pool blue, I'll have to buy the bridesmaid dress for my sister.
She is disabled with Rheumatoid Arthritis and my grandma, aunts, sister, step-dad think that I'M putting too much stress on her by trying to do my wedding my way and turning down her ideas..even though I do it in a very polite, simple way. She says I don't want her to be my mom, I hate her, etc. and gets soo upset/emotional and everyone says I need to "stop whatever I'm doing" because it's going to kill her.
It is so frustrating for me. I'm trying to plan a wedding...the best day of my life, and have my whole family mad at ME because I'm not taking into consideration my mom's ideas that are FAR from what my fiance and I want in our wedding that WE are paying for?
To top it off, she sent me an e-mail yesterday saying that she knows I will have a 2nd wedding because one day I will wake up and realize that my husband is a LAZY, SPINELESS MAN who will never change and I will never bee fulfilled. That hurt me so bad... to know that deep down she is unsupportive of who I want to marry. (by the way, she lives 2 houses down from me & says he is lazy because he isn't outside shoveling as soon as snow starts falling and doesn't mow the lawn several times a week to make it perfect like she thinks it should be done.)
I have had it with her making me feel guilty and upset and turning the family against me & making them believe that I start fights or puposely try to make my mom upset. Nobody cares about my side or takes my side or can even put themselves in my shoes. I feel so alone in my family becuase of it..they buy into my mom's exaggerated, dramatic stories! Everytime we don't talk for weeks, I feel SUCH a weight lifted off of my shoulders.. I am so stress-free, carefree, calm, NORMAL! The second she comes back in my life and we start talking again, I get stomach problems..migraines... anxiety... I can just feel my blood pressure rising and the stress taking over me because of the RIDICULOUS things she gets absolutely enraged about!! (The fact that I wanted to keep my wedding gown at my house instead of my grandma's house in the months before the wedding.. what the heck!? Who cares!!)
My family is very upset that I made the decision to keep her out of my life..she will still be invited to the wedding & such and I'll still see her at family functions... but I do not wish to talk to her and I am accepting of that... there are plenty of people in this world estranged from a family member and if my life is more peaceful and happy without her in it... then that is how I want it to be. This is a person who, when my fiance and I bought our too-expensive house that she CONVINCED us to buy because she promised to give us $100/month toward the mortgage payment just to have us living so close to her.... we decided to take down wallpaper in a room and she thought it was RIDICULOUS for us to waste our time & we needed to paint over it instead...so she said "Well, find someone else to pay $100/month because I want nothing more to do with this house!" and then my whole family practically hated me for that until we started talking again.

I recently set up an electronic funds transfer for my mortgage. When I realized it was for the incorrect amount, I placed a stop pay, following the directions of the bank and paid the fee of $25. After checking for a couple days to make sure the EFT presented and did NOT pay, I called my mortgage company and set up another EFT for the correct amount.
When I followed up a couple days later, I discovered that both had been paid and I was in overdraft for almost $300. Upon discovering this, I contacted the bank. The EFT was for the exact same amount and the exact same mortgage company. When the next EFT payment presented, they paid it as well, thus the overdraft.
I talked to the bank branch manager, who happens to be friends with my brother-in-law (golf buddies). I explained this to him and he informed me that since the EFT had been re submitted without a number the second time around, it was no longer the EFT that I had stopped payment on, so it was paid. I disagreed by arguing that since an EFT was presented for the same amount and to the same company the very next day I should have at least been notified if they were going to pay it, before they did so.
We had a heated exchange on the phone after he informed me that I would have to wait 7-10 days before I would have the original $ back in my account from the mortgage company. I pleaded that I had to have money because I have a foster son that I am legally obligated to provide for and I had no money for groceries, gas, bills, etc. and asked if he could just deposit a minimum amount into my account to cover essentials till the money was back from the mortgage company, which he declined to do. He admitted the mortgage company agreed to reverse the transaction.
He accused me of not taking care of business and that the bank employees could not be expected to "read my mind" and further told me I should bank somewhere that could read minds.
Two days later while speaking with my sister, she asked me about the "problem " at the bank! She proceeded to tell me that the banker had explained to my brother-in-law that I had overdrafted my acount and was complaining about it! He wanted to smooth things over with my brother in law and make sure that it didn't affect thier relationship. My brother-in-law is a financial advisor and broker and makes mucho $ and banks with this same bank.
Do I have any legal recourse for this breach of privacy on the part of the banker?

Here's the situation: My partner and I both lived together for 5 years in a Condo that was completely under my name (Mortgage, title, assessments, etc.). We decided to purchase another property together, it is my second property (as I still own the first condo and use as rental) and his second property since selling his previous property 12 years ago. We both signed our mortgage and title for the 2nd property in August 2008.
Does my partner qualify as a First Time Home buyer even though I am also on the mortgage and title and don't qualify? As mentioned, he used to own property 12 years ago so he technically qualifies as a 1st time buyer as it is way past the 3-year prior home limit.
Not sure if we can claim that he is a first time home buyer on the taxes?? Any help would be really appreciated. If you need any more details please ask, I hope this is enough information.

My husband and I were looking into buying our first home with the intentions of obtaining a FHA loan. However, after doing some research a couple months back, I discovered that my husband had a terrible credit score of 547. The $11,170 student loan that his father was court ordered to pay during the divorce was more than 90 days late on 9 separate occasions. His father never told us that he wasn't paying this loan, and since he was in charge of it, the only contact information they had was his father's and his mother's/his home address (with whom he doesn't talk to). After talking to a mortgage loan specialist, we realized there would be no one that would approve us for a mortgage even given the circumstance. So some friends of mine graciously said that they will give us a place to stay so we can financially focus our money on working off his student loans. So my first question is, if we put more than $2,000 a month down on his loans, how long would it take before his credit score began to rise? Also, my husband threatened to take him to court for violating the court order where his father then said that he would only be able to get a $5,000 loan out to cover the costs. My second question is if we contacted the US Department of Education/Direct Loan (loan lender) and told them the situation, that we had $5,000 to put down on it, and that we could send a copy of the court order, would they remove most of the bad credit with the loan?
If someone could please give us some answers and insight into what we could do I would so very much appreciate it. This whole situation has put such a strain on our marriage and I don't know what to do at this point.

have five credit cards accounts, one auto-loan and three mortgage accounts.
All accounts (except one mortgage account) current and up to date with no delinquinces.But on one of my mortgage accouns i had two 60 days lates in 2008 (first - august-september, second -- november-december). Right now (01/05/2008) all lates paid and there is no due on this account.
But this two lates dramaticaly decrease my credit score. And this is the only bad information on my credit report.

Well, it's been about 6 months since I paid off: my mortgage, a second mortgage and three retail credit cards (all paid off in June, 2008.) So far, all of them are still showing up as open and the full balances still due on all three of my credit reports (I monitor through True Credit.) Am I just being impatient, or are these taking a REALLY long time to update? I have the same problem with my work information. They still list my job from 4 years ago, even though I have written all three to have it updated. Is it possible that I just have a really screwed up credit report that is somehow not updating?! According to True Credit, there hasn't been any updates to my credit report since April, 2008 even though I have been paying off debt like a mad woman this year. Anyone else have this same type of problem?

Many students questioned themselves whether is easy to work while going to school or not? The pros and cons discussed and presented by Amitai Etzioni “The Fast Food Factories: Mcjobs Are Bad for Kids” and Michele Mangers “The Dead-End Kids” has a lengthy works that have much to say about the use and abuse of teenagers who are undertaking and working at franchises such as McDonalds and other fast food industries. They stated that those works does not give teens skills nor does it teach them about the work experience that needed for the real world. Year 2004 I met Mr.Kim who was a mortgage broker.He always tell others that if someone wants to buy a house, they have to hire a mortgage broker to process their loan(He was acting that option #3 does not exist. That way he could get more jobs to sell.). *Someone might say "Why did you trust the mortgage broker? You are stupid..." You will be surprised to know how so many people have no knowledge about these whatsoever.
Anyway I trusted him and year 2005 I purchased my first house.
I filled out loan application and prepared all the documents which was prepared by Mr.Kim. The loan was approved: both first and second lender was major Banks. Exactly 2months later, I received a check book by XX (also major bank) bank. I asked my mortgage broker about this and he said that this was a home equity line of credit by XX bank (3rd mortgage): it was issued based on the current value of my property (there's no loan application and no appraisal report..ect.) and my excellent credit. I had no doubt about this at that time (because it was issued from a major bank) and I used the money for home improvement. My mortgage broker, Kim was sentenced for financial fraud for other cases(currently he is in federal prison)
In the mean time, my mortgage payment was increased dramatically because it was a MTA program which I had no idea what that was at that time... My monthly payment doubled after 2 years and I had reached a point where I could not make all three mortgage payment including the 3rd mortgage. As the real estate market crashed, the value of my house dropped greatly and I could no longer able to make payment. I knew something was not right. I heard about Mortgage Audit from internet one day and decided to do that. I requested all the documents (including original loan applications..) from the all three lenders.
I was surprised to see that there were loan officer's name which I had no idea because I had never met any loan officers. Not only that but also the information on the loan application had wrong information which was prepared by mortgage broker?? or the loan officer??
Since the lender was not a whole sale lender, I had learned that the loan officer from the lender must meet with the borrower directly(Patriot Act?).
What do you think about this whole loan process? I want to know how big crime it is when the loan officer never contacted the borrower and accept all the documents from the mortgage broker and approve the loan despite of all the wrong information on the loan documents??
* Some of you might say, "You signed the documents at the settlement and it is your responsibility"
However both the mortgage broker and the title agent are currently imprisoned. During the settlement, it is almost impossible to review every single document and sign them. I had to trust whatever I sign because it was conducted by title lawyer. Who would not trust "LAWYER" ?? DO YOU THINK LENDER GAVE US A MONEY BECAUSE THEY ARE CHARITY WORKERS?

I called Countrywide home loans today to see if they would combine my first and second mortgage, second is at 11% interest with a balloon payment due. I bought the home five years ago for 340,000.00.
My latest appraisal came in at over 500,000 (renovated). The loan officer at Countrywide tried to convince me the home was only worth 270,000. Of course he has no current data so he could not possible know what my home is worth. What are these people up to now? The last appraisal they did with one of their people was two years ago and 80,000.00 less than what we had the home appraised after their appraiser left. I have a better offer but does anyone know why they are only using their appraisers and giving people false information?

I ended up not doing a deed in liue with WellsFargo, they allowed me to modify the loan...but now I can't modify it because Countrywide reports it as 'foreclosure'.
Anyway...Countrywide received the funds, released the lien but reported it as 3 different ways to all 3 credit bureaus as: 'pre-foreclosure', 'Creditor Received Deed', and 'Forefeight of property in lieu of foreclosure'. I was NEVER in Foreclosure with Countrywide.
How to correct I did? I contact the credit burau where I sent the letter Countrywide requesting a funds to settle and a letter informing htat they got the funds, a letter indicating deed was released and recorded. Nowhere it indicates that Coutnrywide will report it as foreclosre?
ADDING DETAILS:
I did dispute with the Credit Bureau but they rejected updating it. Credit Bureau DID NOT PROVIDE any documenation...simply updated the dispute stating 'New Information Available' which is the same as previous.
Should I get a lawyer? Has anyone had a similiar situation?

Hello,
I'm currently doing a loan modification. I hired an attorney-backed company six months ago to handle the matter for us. So far, we have been VERY displeased with the service.
Long story short, we own two properties. The lender is GMAC. One property (our investment) has already been modified as of three weeks ago. The second one is taking forever!
I had entrusted that the company was doing their job. However, six months later, we're getting nowhere it seems like. Basically GMAC asks for financials, we fax it right away to our loan modification company, then we later found out GMAC never received them for whatever reason. And according to the loan mod firm, GMAC keeps losing our paperwork!
When I signed the contract with the loan mod company, we were current on all payments. Now, six months later, my property that I currently live in just had a Notice of Default filed last weekend!
I forwarded this information to the loan mod company. Apparently the loan mod company failed to include both mortgage account numbers in the financial info they faxed over to GMAC over a month ago. So therefore, the faxed info only got applied to my other account which is the one that was just modified and not my owner occupied residence which is why we're still struggling to get it modified. So the loan mod co refaxed it to them about three weeks ago. And we were told it would be 15 working days before we get any answers.
Yesterday, we find out that they never got the fax!!! So I'm now 90 days away from foreclosure. And I just spoke to GMAC and since my property taxes are late, they are now applying for an escrow account. They said at this point, it should be another 4-6 weeks total before we get an end result.
So as you can see, it's been nothing but delay after delay after delay. The loan mod company is not doing their job in following up with GMAC to make sure they got the paperwork.
I'm worried sick to my stomach. I don't want to lose my home, especially due to someone else's stupid mistakes!! I can no longer trust the loan mod company to do the right thing for us. They assure us they're doing everything within their power and that some loans take longer than others. Just depends. In my opinion, it should have never taken this long! It is very obvious to me that it was due to their lack of following up with GMAC that things are taking forever! Six months and no loan mod yet!!! Ridiculous!
We are perfect candidates in every way. If done properly, I know for a fact that we will get a mod. Basically my question is, now that I have an NOD and it could still potentially take 45 more days for the loan to be modified and not trusting the current company that's handling my loan, should I seek another attorney? Should I just stay persistent and make sure everything is being handled? I'm at a total loss here.

Let me offer some information as to why I am torn on the answer to this question.
A few years, I had a friend who got into the mortgage business, flourished immediately, and quickly became the branch manager. He called me and said, Nick, you have to get into this....there's money everywhere!
So, being young, naive, and broke, I went for it. My first month, I made about $8,000. My second, $12,000. Then $14,000. Then I made $16,000 off one deal! And think about this, if I made that much, how much did my boss make?!?! And how much did the bank make? But you know what I was doing? I was selling people into Neg-Am Loans for a huge rebate.
All of the people I sold those loans to are FOR SURE going into Foreclosure. Once I realized what I was really doing (2003-2004), I quit, went back to school, got a Marketing Degree, and moved on to a job where I could sleep at night. But I still had a ton of friends in the Mortgage business. And it wasn't just the Loans making money. It was Title companies, Real Estate, Escrow, Appraisers, etc, etc. I have friends my age (27) who were making 30k, 50, 100k A MONTH doing Loans or operating Broker offices. KIDS! Kids with a gift of gab who can't even spell making $300,000 a year!!!! WHAT IS WRONG WITH THIS PICTURE??
I felt a huge amount of guilt, but realistically, I can't blame myself. I was a 22 year old kid who started a new job and did was I was taught. When I had the moment of clarity, I got out even though I could have made a killing screwing people over.
So, who's fault is that?
Is it the consumers fault for signing the loan documents on houses they couldn't afford and loans they didn't deserve, not fully realizing what they were getting into?

We received a single step construction loan from a mortgage broker. After construction, we were ready to close our loan, and suddenly the broker said they could not close the loan. Because of the decline in the marked we were not able to sell our existing home, and they said this meant we could not close. However, they never disclosed to us that we had to sell our home. It was listed for sale, but we would never have guaranteed our house would sell!! They approved our loan, funded our loan, and then said they couldn't close. Then they gave our loan to another broker without so much as a phone call. Suddenly I received paperwork from another broker. When I called the new broker she said the previous broker had give her all my information. We ended up closing with them, but instead of the single step construction loan, we ended up having to close with a second set of closing costs, increasing our loan, and payment, even more!!
I am thinking about suing the the mortgage broker for the costs of the second closing fees, does anyone think I have a case? Any advice? Any lawyers out there want to do a consultation?
Please help!!For clarification, all of my spreadsheets, documents, and even all of their advertisements state, single step construction to permanent loan. We had a pre-approval letter, and then funding documents all based on our current financial situation. How could everything be approved by underwriters, and then at the last minute they change thier minds? They still made a lot of money off the interest that was paid to them for our construction loan period, they held the loan for six months and when it was time to convert. Then we had someone new to deal with. And the agent at the seconde mortgage broker we ended up closing with, now works for the first mortgage broker!!!!!

I just ran my husband's credit report and noticed that six different accounts appear for his Stafford Loan for graduate school. The loans are all through the same bank - Wachovia. Each semester they take out these loans so therefore it looks like he gets a new student loan every 6/7 months. First, can we correct this? Second, why are there six different accounts? Sorry so long, but I want everyone to be sure they have all the infomation.
I had a baby sitting job for a very short amount of time. I was watching two children ages 11 months and 8 years old. I watched them on average 2 days a week and sometimes 3 days a week and not always were they full days. I was providing two meals, all drinks, and snacks and often diapers. Providing transportation occassionally also for one way. I was being paid 600$ a month.
I quit watching the kids with one and ahalf days left in the month that I was suppose to be doing it due to some violent behavior the oldest was showing (He threw a chair at me twice when I asked him to sit down in time out and hit me when I told him that that was NOT Ok! The second time the chair almost hit my own little girl who is 12 months.). I decided I couldnt risk this behavior around my little girl.
When I was asked for the remaining money back for the day and a half I did not watch the kids, I told her i felt inclind to keep it to re enburse me for the diapers and snacks I asked her to provide inwhich she didnt do.
An arguement ensued, so I told her that I really didnt care to fight, so I would pay her back and just count my losses to just be done with this situation. I told her I didnt have it at that point though due to HUGE vet bills that had encured with my dog which had set me behind on my mortgage, but I would get it to her as soon as I had it and if we could work something out.
She threated to take me to court and to call the police...I was like, ok..please do.
This was three weeks ago. Today, I recieved a phone call from Welfare saying they got word of me babysitting and running a day care and that my benifits (Food stamps) were at stake. I am not running a day care or bringing kids in and out of my home. They needed help with their kids (They were my hubbies co workers) and we could use the extra money, I was doing it to help them out as it would also help us out, I figured everyone would win). But it didnt last even a month....
We are low income and struggle to make it sometimes. This baby sitting job was a one time deal, I tried it for a month and it didnt work out, so no, I didnt report it and I wont be doing it again. I was told you didnt have to report incom euntill you made over $1,000 in which I obiviously did not.
This woman is looking to cause trouble for my family and I am really upset over this because she is looking to take food from my daughters mouth by reporting this as a "steady" job, which I am not working or babysitting or running a day care... I am a stay at home mom caring for only my child
I fear she is going to call CPS and make false reports also....which I am not to concerned about, they would look at my home and my daughter and have no concerns I am sure..but I dont want to deal with the stress of it...I kind of feel I am being harassed....

About 2 years ago, she went through his phone and started calling all the women and accusing them of having affairs with him. This included myself and several women that we work with and his other friends including florists and other female business contacts. All of which was unfounded and not true. His wife kept the numbers she found and would sporadically call us insinuating there was an affair. She would also text graphic an sexual language from his cell phone trying to provoke some seedy or romantic information to try and validate her claims of an affair. Again, there was nothing.
During their separation, she stayed in their house with her two children from her previous marriage. It was agreed between the two of them that they would split the mortgage 50/50. He was paying her his half and she was pocketing the money knowing that she did not want the house after the divorce. This totaled approx $7000.00 over a 3 month time period. She did not disclose this to him and since all the mail was still going to house, he did not receive it. After getting back into the now trashed house (carpets ruined, cabinets broken, spray paint on walls) he learned that she had not been making the payments. She was (of course) not cooperative with the divorce paperwork but they finally came to the agreement that they would 50/50 their last years tax return, he would try to get the house financed under his name alone (now that she ruined their credit it was going to be hard), they would both get one vehicle that they were financially responsible for, and they would go their seperate ways. They were both in understanding that she owed him $3000.00 for the money she pocketed in the mortgage payments. Their tax stimulus check was just received and deposited in his bank account. She has since been texting both him and I that she is going to get him fired by going to our boss and claiming that he is committing tax fraud because he is keeping the stimulus check. The stimulus check does not even cover half of the money owed to him by her, and it was legally deposited into his checking account by the IRS. He has told her that she was not getting anything from him financially that was not in the finalized court documents because of the high amount of debt she left him with. In their divorce paperwork the only monetary item agreed on in reference to taxes was the actual tax return, which was generous because she did not have any income for that year by her own choice.
She has always sent me nasty text messages, including the typical "I heard you are ugly" and stuff like that, to claiming that he beats his children and to fear for the life of my dog because it will be beaten too. Now with this whole stimulus check thing, she is sending me messages that if I don't tell him to pay her she will get him fired by claiming tax fraud, child abuse, and that he was stealing money from charity events. All of which, again, is untrue. She also is threatening us that she is going to tell our boss that our co-workers/friends were having extra-marital affairs (which is also untrue) in an attempt to make us feel bad about ruining someone else's marriage.
All of her aligations are untrue and we are not worried about that. He told her to take him to civil court if she wants to and see what the judge decides. It would be easy to just give it to her to make her shut up, but everytime she needs money she pops up with new threats. She has been doing this since their divorce. If she needs car tabs, clothes, beauty treatments, car payment money, or anything she starts making new claims. If we pay her now, she knows she will be able to continue to do this.
What's the right thing to do? What should I do about the constant text messages? And would any of this constitute Slander or Extortion?

I made an offer on an REO house, the selling agent we've been working with came back and said there's another offer and we're going to do a better and best. Now, I don't know for sure if there really is another offer, for many reasons I won't go into.
Okay, so we made a second offer. The mortgage broker said it was a good offer and the agent acted as though it was good too, so i feel confident. The mortgage person said we should know in a couple of days.
Okay, our offer has one contingency, we want the furnace to be put in. When I mentioned this in my first question, everyone tore it down and flooded me with negativity. Well, it is a house code violation and the bank knows they won't get their money, so it IS fair to ask for this.
Anyways, the bank says they will put the furnace in if we can prove that our funds will be available. So the mortgage company wrote a letter to the bank stating that if the bank puts the furnace in before or one day after the closing date, we will recieve funding.
Okay, so my question finally is...how does this sound? Have you been in this situation? I'm fairly confident this is going to happen and we want it very badly. It's so stressful but its been fun too.
Also, we did this yesterday, I'm thinking that if we don't hear from the agent by tomorrow afternoon, we're going to contact her and get some information. This couldn't hurt, right? Either she will know or she won't. So, please don't talk to me about the bank taking their time, they've been pretty quick so far.
Please don't flood me with a bunch of negativity again either. I don't want to sound rude, but I would really just like some honest feedback about what you think.

We were told to make a second offer because there's another bidder and their offer was close to ours so the bank wants to see who's is best. This, I believe, was a trick to get more money out of us. And I am still not convinced that there is another bidder. There is no furnace and no other heating in the house. It must be fixed.
Also, to the first answer, i'm sorry I forgot the name...I'm not saying the bank is obligated. But they know they nobody will recieve funding if the house is without a furnace, and in Michigans economy, nobody is going to put in a furnace and risk eating it if something goes wrong. So, sure they're not obligated, but they know its something that has to be done if they want the sale. So, thats why we're sticking to our guns on that part.

Now the second mortgage company which is the same as the 1st mortgage is trying to collect. Since there is no more collaterol for the second mortgage, do I have to pay that loan as well. I was the primary on the loan. The loans were with Homecomings Financial. We had made the payments, but they said we didn't make the payments, although we had proof that they were made. I am looking at buying a second home in my area to rent it out. The mortgage brokers have said I can do this by releasing the equity in my home to put down as a deposit. I had plans to buy a second property that needed a bit of work, so I could then release the equity and do it all over again. Only I have looked at some figures and I can buy a house for about 90k, I wouldnt make much of a profit from the monthly rent but am looking for more of a long term investment (approx £50 a month profit) however if I remortgaged this property for approx 110k that would take my monthly payments over what I could make as a rental income. So what I am basically asking is how do other people build up a big portfolio of rental properties with all this information in mind? Any help greatly appreciated.

I've had debt collectors ask if I have any brothers or sisters that I could "borrow" money from (I'm an only child) and they go on and on asking if I have friends to help me out.
Now, I know this goes against their FDCPA rules But what they DO with the information once you tell them that you do not know people like that? Do they write it down or something?

Im thinking that this news will negatively effect people to buy houses becuse houses will be more expensive and the cost of maintaining the house will also require more funds. However, I don't really know if it can positively effect people as well because since housing prices go up, there is a greater rate of return on the house (i'm not sure if I got this right).

The first charge on the property is with Halifax. I have found that he was behind with mortgage payments through a redemption statement. Halifax will not disclose any information the property due to the Data protection act. I need to know when halifax would take action on possession of the house. The house has been empty for a long time and looks like nothing is being done. I am worried that with house prices falling that due to my second charge i will be left with nothing!!!

We have a mortgage with option one mortgage they have been terrible to deal with from the begining. We have made all our payments on time. They are reporting to the credit bureaus that we have been late 3 times on our first mortgage and once on the second mortgage i have papers i printed off option one mortgage's website pertaining to my account information and the credit of payments to my account's with option one mortgage. They plainly state the payments were not made 30 days late i have disputed these items with all 3 credit bureaus for over a year now. I have also disputed these with the mortgage company and get no where! The credit bureaus just tell me the information was verified and it remains on my credit but it is incorrect information i have sent the credit bureaus copys that shows the payments were not late! I dont know how they come to these conclusions! option one keeps reporting this even though i have papers printed off their own website that shows otherwise!I have been trying to find out what kind of lawyer i should contact for something like this but have been unable to find that out if anyone could point me in the right direction it would be much appreciated!

Wow, sad story. Bought a second mortgage thinking it was a first. Have bought first before and usually have all the information right, but screwed up for the fix and flip we thought we were buying. Now find out the first mortgage being foreclosed is about the same as the value of the house.
Now as I understand, the second was actually three times what we paid. Would not get that back in auction, but wonder if there is some way to sell it again?
Not sure what we can do except:
1. Take our losses and learn a lesson I wish I hadn't
2. Offer an amount on the first mortgage to see if we can cut our losses with a fix and flip anyway.
Is there another way out? Has anyone bought a second mortgage without buying the first as well and got their money (or profit back)? Painfully awaiting any knowledgeable answers.
